Terms of Use

Your access, registration and use of the DATA STEWARDSHIP WIZARD Tool (the ‘Tool’ or ‘DSW’) and its associated tools and/or components confers upon you the status of ‘User’ and constitutes the express, full and unconditional acceptance of these Terms of Use (the ‘Terms’).

Please note that these Terms may be subject to periodic updates; we recommend reviewing them regularly to ensure your continued compliance.

Legal Notice

Pursuant to the obligations provided by the Spanish Law 34/2002 on Information Society Services and Electronic Commerce (hereinafter, LSSIYCE), the BARCELONA SUPERCOMPUTING CENTER - CENTRO NACIONAL DE SUPERCOMPUTACIÓN (BSC-CNS) states that the domain dsw.bsc.es is the property of the BSC-CNS, with tax code S-0800099-D and registered office at Plaça Eusebi Güell 1-3, Barcelona (Barcelona).

Definitions

Content
Any information, data or text found on the BSC-CNS DSW Tool uploaded by the User.
Data Stewardship Wizard
(hereinafter, “DSW” or “Tool”) An open-source tool for collaborative and living data management plans. The Tool provided by BSC-CNS is a support activity, free of charge, without obligation or guarantee of any kind, and which, in no case, can be understood as a service in a commercial or contractual sense.
User
Any individual who owns a registered account on BSC-CNS DSW and accesses to it in order to make use of the Tool.
Account
A User-controlled means of access to BSC-CNS DSW that is protected by a User-created login username and password, with which Users can obtain access to BSC-CNS DSW functionalities.
DMP
Stands for Data Management Plan, which is a formal document outlining how data will be collected, stored, processed, shared, and preserved throughout the lifecycle of a project, according to each project needs and specifications.

Tool

The Tool provides the User the ability to create, manage, collaborate, share, and download DMPs and other data stewardship-related documents based on standard user-designed forms.

It offers an interactive and structured approach to planning data stewardship, preserving institutional, national, and international best practices, including FAIR principles.

The Tool permits Users to answer guided questions, generate structured outputs, and integrate with relevant external resources to facilitate efficient and standardized data management planning.

Access and usage conditions

The Tool is available to researchers, research communities, and institutions wishing to create and manage their own data management plans, tailored to the specific needs of their projects, using template-based forms.

Access is granted following registration through the SIR2 system using an institutional email address.

Access rights are personal, non-transferable and temporary.

The Tool is provided free of charge and is intended exclusively for institutional and non-commercial research purposes.

4.1. Permitted Use

The User is solely responsible for their use of the Tool in accordance with these Terms. To ensure compliance, the User should take precautionary measures, including but not limited to:

Users must respect and follow the legal protection provided by copyright and licensing of software and data as well as intellectual property and confidentiality agreements when uploading or downloading the Content.

4.2. Non-permitted Use

Users shall not use the Tool in any manner that violates these Terms, disrupt the normal use of the Tool by other Users or impacts the privacy, integrity or security of other Users, and shall refrain from:

Termination

BSC-CNS reserves the right, at its sole discretion, to regulate, restrict, suspend, or terminate any User’s access to all or part of the Tool at any time and without prior notice. This may occur if the User’s role or projects no longer require access, in the event of a breach of these Terms of Use, or in cases of unauthorized use of the Tool or its Content. BSC-CNS shall not be held liable for any such actions.

BSC-CNS is not responsible for verifying the accuracy, legality, or completeness of the Content. BSC-CNS reserves the right to review and/or manage any Content added to the Tool by the User with the aim of ensuring compliance with these Terms.

If BSC-CNS detects an infringement of these Terms by the User, it reserves the right to restrict, suspend, or terminate access to the Tool immediately. This termination decision may be reviewed if you contact datamanagement@bsc.es within one (1) month from the date of access suspension.

All provisions of the Terms of Use that, by their nature, should survive termination shall remain in effect after termination. This includes, without limitation, provisions related to ownership, warranty disclaimers, indemnification, and limitations of liability.

Personal data collection and processing

The User may provide personal information for registration and access purposes to the Tool (Access includes administrative, operational, accounting, monitoring and security). This information may be exchanged, via secure federated authentication mechanisms (SIR2/RedIRIS), only to the extent necessary for authentication within the Tool, between BSC-CNS and institutions that act as Identity Providers (IdPs). A current list of partner institutions will be displayed during registration, and your explicit consent will be requested before any personal data are exchanged or displayed to users from those institutions. No personal data will be transferred from BSC-CNS to partner IdPs, except where required by law.

In having an account on the Tool, you acknowledge that:

In compliance with the General Data Protection Regulation (GDPR), personal data will be retained only for as long as necessary to fulfill the purposes outlined in this Section. According to the GDPR, personal data will be managed by persons who may take part in some of the projects and Data Management Plans. The processing is necessary for the performance of a contract to which the data subject is party. The personal data will be deleted after 5 years of account inactivity, under the necessity principle. Metadata can be saved for audit purposes. Users shall have the following rights regarding their personal data collected and processed by the Tool: Right to Access, to Rectification, to Erasure (Right to be Forgotten), to Restrict Processing, to Data Portability, to Object, to Withdraw Consent. To exercise these rights or for further inquiries about personal data handling, users may contact the BSC-CNS at dpo@bsc.es. You may also file a complaint before the Spanish Data Protection Agency. In case of breach or international transfer, BSC-CNS will follow what is described in the GDPR.

Intellectual Property Rights

7.1. Ownership of the Tool

The Data Stewardship Wizard (DSW) Tool, including its underlying source code, design, structure, and any associated software or documentation, is an open-source platform licensed under the Apache License 2.0 and remains the intellectual property of its respective authors and contributors (developed and maintained by the ELIXIR Czech Republic team). The BSC-CNS has carried out minor modifications to the original codebase. These modifications are also licensed under the Apache License 2.0 and are shared in accordance with the terms of the original license, which governs the use, reproduction, modification, and distribution of the Tool and its components.

BSC-CNS has deployed and maintains a local instance of the DSW Tool in its own infrastructure and offers the service in-house to its users. This deployment is based on the open-source version of the Tool and operated in accordance with the licensing terms and best practices for internal service provision. Users must comply with all applicable license terms when using the Tool.

7.2. Content Uploaded by Users

Users retain all intellectual property rights over the content they provide while interacting with the Tool, including responses to quiz questions and open text input ("User Content") that contribute to the generation of Data Management Plan (DMP) templates. By submitting such content, Users represent and warrant that they have the necessary rights, licenses, or consents to provide it, and that their input does not infringe the rights of any third party. Users acknowledge that their input may be processed by the Tool to produce structured DMP templates, which may be further used, shared, or exported by the Users. Tool administrators may access User Content solely for the purpose of maintaining, supporting, and improving the Tool, and will handle such content with appropriate confidentiality.

7.3. License to BSC-CNS

By submitting Content to the Tool, Users grant BSC-CNS a non-exclusive, worldwide, royalty-free license to use, host, reproduce, display, and distribute such Content solely for the purpose of operating, maintaining, improving, and providing the Tool. This license is limited to technical and operational needs (e.g., backups, performance monitoring, interoperability with external systems) and does not grant BSC-CNS rights to use Content for commercial purposes or disclose it publicly without prior written consent from the User.

7.4. Third-party Resources and Integrations

The Tool may provide access to or integration with external resources, templates, or services operated by third parties. Such content may be subject to additional terms or licenses. BSC-CNS does not claim any intellectual property rights over such third-party content and disclaims all liability regarding its use or availability.

7.5. Infringement and Takedown

BSC-CNS respects the intellectual property rights of others and expects Users to do the same. If BSC-CNS becomes aware of any User Content that may infringe the intellectual property rights of third parties, it reserves the right to remove such content and may suspend or terminate the associated User account. Any concerned parties may report alleged infringements to the Tool administrators.

No warranties

All Content and Resources are provided “AS IS” and “AS AVAILABLE” and without warranty of any kind, express or implied, including, but not limited to, the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose, and any warranties implied by any course of performance or usage of trade, all of which are expressly disclaimed.

Without limiting the foregoing, BSC-CNS does not warrant that: (a) the Content are timely, accurate, complete, reliable or correct in their posted forms on the Tool; (b) the Tool will be secure; (c) the Tool will be available at any particular time or location; (d) any defects or errors will be corrected; (e) the Tool or any Content are free of viruses or other harmful components; (f) the results of using the Tool will meet your requirements; or (g) data may be lost. Your use of the Tool and any content is solely at your own risk.

Liability

Users are always solely responsible for ensuring the adequate backup of all data, information and content uploaded, transferred, made available from and/or created on the Tool. Users understand that the Tool does not include any obligation on BSC-CNS to safely backup any data or ensure the integrity and safety of any data or protect any data from loss of use, alteration, destruction, degradation, corruption or damage.

Users are solely responsible for the consequences of infringement of these Terms and will respond for all activity that occurs under their own username. In no event shall BSC-CNS and its affiliates, directors, employees, agents, partners, or suppliers, be liable under contract, tort, strict liability, negligence, or any other legal theory with respect to the Tool (i) for any direct or indirect damages, or (ii) for any lost profits or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever.

By accepting these Terms, the User agrees to indemnify and hold BSC-CNS harmless from any claim, demand, loss, cost, expense, liability, or damage arising out of or related to: (i) Content submitted, posted, transmitted, or otherwise made available through the Tool; (ii) the User’s access to or use (or misuse) of the Tool; (iii) any violation of these Terms of Use; or (iv) any infringement of third-party copyrights or other rights, including those of other Users.

Miscellaneous

The BSC-CNS may assign, transfer or delegate any of its rights and obligations hereunder without consent. No agency, partnership, joint venture, or employment relationship is created as a result of the Terms of Use and neither party has any authority of any kind to bind the other in any respect outside the specified terms of this Agreement. If any provision of the Terms of Use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms of Use will otherwise remain in full force and effect and enforceable.

Dispute Resolution

These Terms of Use shall be governed by and interpreted in accordance with the laws of Spain. All disputes under these Terms of Use will be resolved in the courts of Barcelona, Spain. The User consents to the jurisdiction of such courts and waives any jurisdictional or venue defenses otherwise available.
